terms of service
These are the terms for using Red Eye Fund (redeyefund.com), operated by Red Eye Fund LLC. Short version: we chase the compensation your airline owes you, we take 25% if we win, and you pay EUR 0 if we don't. The long version is below, and it's written to be read.
What we do
We pursue air passenger compensation claims under EU Regulation 261/2004 and its UK equivalent. If your flight landed 3+ hours late, was cancelled with less than 14 days' notice, you were denied boarding, or a delay wrecked your connection, you may be owed EUR 250, 400, or 600 per passenger depending on route distance. Start a claim at /pages/claim and track it at /pages/claim-status.
We work through the airline's complaint process and, where needed, the free national enforcement bodies and ADR schemes. We do not go to court. We are not a law firm and nothing we say is legal advice - we're a claims service run by people who have also slept on terminal floors.
The fee
Our fee is 25% of the compensation actually recovered. No sign-up fee, no admin fee, no fee-for-trying. The airline pays compensation directly to you; once it arrives, we invoice you for our 25%, due when you receive the money - never before. If the claim fails, you owe us nothing.
The Letter of Authority
To act for you, you sign a Letter of Authority. It lets us contact the airline and the relevant enforcement body or ADR scheme about the specific flights in your claim - and nothing else. It does not let us receive your money or represent you in anything beyond that claim. You can revoke it at any time via the on-site chat.
No guarantees, ever
We will never guarantee a payout, and you should distrust anyone who does. Extraordinary circumstances - severe weather, air traffic control strikes, and similar events genuinely outside the airline's control - are excluded by law. No claims company can change that.
Honest declines
If your claim doesn't qualify, or the only realistic route to payment would be court action, we'll tell you plainly, decline it, and you'll owe nothing. We'd rather lose a claim honestly than string you along for months.
Your side of the deal
- Give us truthful, accurate, complete information.
- Forward any correspondence you get from the airline.
- Tell us if the airline pays or offers you directly - cash or vouchers. Our 25% still applies to compensation recovered through the claim, however it reaches you.
- Don't run a parallel claim for the same flight elsewhere.
- Reply to us within a reasonable time so the claim keeps moving.
Cancelling
You have a 14-day cooling-off period from signing up, no reason needed. Beyond that, you can withdraw free of charge any time before we file your claim with the airline. If you cancel after filing and the claim later pays out because of our work, the 25% fee still applies - fair's fair.
Data
We collect only what the claim needs and delete it after payout or on request - the full detail lives in our Privacy Policy at /pages/privacy.
Changes
If we update these terms, the new version applies from the date it's posted here. For claims already in progress, the terms you signed up under keep applying.
